- Act as a nominated Responsible Manager under the AFSL, ensuring derivatives activities comply with the Corporations Act 2001, ASIC Market Integrity Rules, and relevant regulatory guides
- Oversee the preparation, review, and distribution of Product Disclosure Statements (PDS) and Product Design and Distribution Obligations (DDO) Target Market Determinations (TMDs)
- Ensure compliance with ASIC's product intervention orders relating to CFDs and derivatives
- Monitor and implement changes arising from regulatory developments affecting crypto derivatives
- Ensure appropriate client classification (retail vs wholesale) and maintain documentation supporting wholesale client certifications
- Support AFSL licence conditions, renewals, and ASIC inquiries
- Implement and oversee robust client suitability assessments for derivatives trading
- Ensure clients receive appropriate risk warnings and disclosures before trading
- Enforce leverage limits, margin requirements, and negative balance protection in line with ASIC requirements
- Oversee margin call processes and ensure timely client communication
- Supervise the execution of derivatives trades, ensuring best execution and fair treatment of clients
- Develop and maintain operational policies, procedures, and controls for derivatives trading
- Ensure accurate trade reporting, record-keeping, and reconciliation processes
- Oversee client onboarding for derivatives, including appropriateness testing and certification verification
- Identify, monitor, and mitigate market, credit, counterparty, and operational risks in derivatives activities
- Conduct regular stress testing and scenario analysis on derivatives exposures
- Report material risks and breaches to the Compliance Officer and Board
- Contribute to business continuity planning for derivatives operations
- Manage client complaints related to derivatives, ensuring resolution within IDR timeframes
- Liaise with AFCA on escalated disputes and ensure timely responses
- Prepare and submit regulatory reports to ASIC as required
- Maintain audit trails and documentation for regulatory inspections
- Train and supervise staff on derivatives products, compliance obligations, and client suitability requirements
- Ensure team members maintain RG 146 competency and ongoing CPD requirements
- Promote a culture of compliance, integrity, and client-centric service
- Maintain and demonstrate derivatives proficiency through annual competency assessments
- Stay informed on market developments, product innovations, and regulatory changes
- Significant experience in financial services with substantial exposure to derivatives dealing, structuring, or risk management
- Demonstrated experience serving retail clients in a derivatives context (mandatory)
- Proven experience operating within an AFSL-regulated environment, ideally with exposure to crypto derivatives or CFDs
- Track record of managing margin, leverage, and client suitability frameworks
- RG 146 compliant (Tier 1) for derivatives products
- Relevant tertiary qualification in Finance, Economics, Law, or related field (highly desirable)
- Additional certifications in derivatives, risk management, or compliance (e.g., CFA, FRM, or equivalent) advantageous
- Strong understanding of the Corporations Act, ASIC Regulatory Guides (RG 104, RG 105, RG 166, RG 212, RG 227, RG 274), and ASIC product intervention orders
- Thorough understanding of retail client obligations and wholesale client certification requirements under the Corporations Act
- Deep knowledge of derivatives markets, including futures, options, swaps, and CFDs (crypto and traditional)
- Familiarity with leverage management, margin calculations, and risk controls
- Excellent communication, stakeholder management, and leadership skills
- Ability to operate effectively under pressure in a dynamic regulatory environment
- Must be an Australian citizen or permanent resident
- Satisfy ASIC's fit and proper person requirements
- Willingness to undergo police, bankruptcy, and regulatory background checks
