Director, Compliance - ChinaThe Position
The Director, Compliance - China is a business oriented, flexible, well-rounded professional who has experience and capability to support various aspects of a global legal and regulatory corporate compliance program for a large, diversified, global manufacturing and hospitality business. The selected candidate will be cross-skilled in multiple compliance program activities and will have the ability to support projects and work with local teams and business professionals to build local policies, procedures, integrated system controls, and processes / activities that protect the business from legal and regulatory risk. To perform the work, this professional will utilize prior knowledge and firsthand experience, education and training, information obtained from benchmarking and professional networks, guidance from regulators and enforcement agencies, input from business teams, and research and analysis of best practices. The professional will also support various special projects related to compliance and ethics.The role requires basic knowledge of and/or familiarity with legal, compliance, and regulatory risk areas impacting a global business such as Kohler Co., strategic thinking, solid judgment, a strong work ethic, the ability to excel in a fast-paced international environment, and outstanding interpersonal and technical skills. This position will be part of the Kohler Co. Compliance and Ethics Team and will report to our VP - Compliance & Ethics based in Wisconsin, U.S.A. The selected candidate will work closely with the central compliance organization and support the areas below.Core Roles and Responsibilities
Gains a thorough understanding of the Company's products, regional businesses and operations, people, legal and compliance risks, culture, and uses that knowledge to support an effective local compliance program in alignment with the global program.Champions the Company's values as the foundation for the compliance program.Builds trust / credibility and develops effective relationships with key stakeholders in region.Attends and participates in business and culture building activities, such as town halls, staff meetings, and focus groups.Uses familiarity with U.S. enforcement agency requirements and other global requirements to help support design and maintenance of an effective corporate compliance program.Promotes the company's ethics helpline and supports triage of issues raised to the team.Partners with legal and/or subject matter experts to conduct internal investigations into potential policy and legal issues raised to the C&E team, as assigned.Activities include interviewing employees as needed, reviewing records, developing facts, drawing conclusions, determining root cause and corrective actions, authoring a concise report, monitoring closure of corrective actions, and reporting investigation results.Highlights potential emerging risks and/or systemic issues.Works with legal team and subject matter experts to monitor applicable laws, regulations, and/or other country developments and ensure awareness and potential impact to Kohler Co.Works with central compliance organization to support a periodic legal and compliance risk assessment and work with subject matter expert to support abatement activities.With direction from the central compliance organization, supports monitoring transactions and activities for compliance with legal and policy risk areas, such as anti-corruption reviews, high-risk third-party relationships, gifts and hospitality pre-approvals, and conflicts of interest disclosures.With direction from the central compliance organization and subject matter experts, contributes to creation of effective localized compliance and ethics policy training.Supports design of training for associates, people managers, functions, business partners.Supports Global Ethics Week training and activities in the region.Supports employee completion of training modules assigned via software system.With direction from the central compliance organization, supports the creation and deployment of localized compliance newsletters and other key messages.With direction from the central compliance organization, supports projects of global ethics champions and deployment of ethics surveys to assess and drive regional ethical culture.Supports other global program activities and team members as requested.Skills/RequirementsThe Person - Qualifications and Experience (Required)
At least seven years of experience working in compliance and ethics, risk management, or the legal function within a global manufacturing firm, consulting firm, law firm, or equivalent.Bachelor's degree or equivalent undergraduate degree.While a law degree is not required, it is a factor due to close coordination and interaction with legal and regulatory professionals.Unwavering commitment to ethical business practices and compliance with laws.Experience conducting internal investigations into policy/risk areas.Excellent written, oral communication, and presentation skills.Ability to quickly build rapport within the company at all levels and influence others.Strong collaboration skills and ability to partner effectively within teams and business units.Understands culture in the region.Self-motivated, strategic, innovative, and detail oriented.Language skills: English and Mandarin Chinese fluency.Desired
Adept at use of software products for compliance program management (i.e., Ethics Helpline).External focus: participation in external professional compliance associations.Compliance certification by a reputable organization, such as SCCE, ECI, or other.Strong project management skills and ability to prioritize and drive forward multiple initiatives in a timely manner working with a large group of stakeholders.Location
