Provision of legal advice in response to business requirements on increasingly complex and/or higher value matters typically with moderate or occasionally significant Sector impact. Initiates and implements some more proactive legal services. In each case within a Sector, region, business or functional team liaising with business clients generally not at the most senior level within the Sector or function. May manage people. Moderate level of oversight by more senior lawyers, decreasing with experience. Works independently within established functional practice. Confirms direction and judgements with more senior colleagues on complex or high value matters or where not seen before.PRINCIPAL ACCOUNTABILITIES
  • Providing sound and pragmatic legal advice to stakeholders at all levels in JM’s China and South-East Asia organization (and globally) regarding key compliance risk areas and reputational risk management issues.
  • Conducting and supporting confidential investigations into potential unethical or illegal behaviour (including those arising under JM’s ‘Speak Up’ policy) and feeding lessons learned back into the organization.
  • Providing regular reports to China Management Committee regarding Group Ethics & Compliance developments, notable trends or concerns and opportunities for improvement.
  • Adapting Group Ethics & Compliance policies, procedures and standards to account for Chinese legal requirements as necessary and embedding them locally to ensure adherence.
  • Counselling on compliance with JM’s Third Party Intermediary procedure, gifts and hospitality requirements and bribery and corruption risks associated with public official interactions.
  • Supporting Group Ethics & Compliance risk assessments, training and monitoring/assurance activities in China.
  • Ensuring consistency of approach to legal compliance issues across Sectors and Functions in China and in the wider South-East Asia organisation.
  • Assisting the Group Ethics & Compliance team in supporting the Ethics Ambassador network in China, Asia and globally.
  • Helping to embed/reinforce JM’s culture of Doing the Right Thing, which includes travel to JM’s sites in China (and globally).
  • Engaging and managing external counsel where appropriate.
  • Performing any other duties within the employee’s skills and abilities whenever reasonably instructed.
SCOPE
  • Jurisdictional remit focused primarily in China with occasions when it is necessary to assist with APAC and RoW matters, working flexibly with counterparts in the UK.
  • Influential at all levels including senior management, Sector/BU management and with all functions (eg, Group Legal, HR, EHS, Group Assurance & Risk, Tax, Learning & Development and Corporate Communications).
  • Support the Assistant General Counsel, Ethics & Compliance and Sustainability, in decision-making and providing direct advice to the businesses/functions in China (and globally where required).
  • Develop strategic priorities within China in consultation with Assistant General Counsel, Ethics & Compliance and Sustainability.
  • Ability to work without close supervision.
  • Ability to engage with the businesses/functions and work to change behaviour where necessary.
  • Requires a collaborative approach within the Group Ethics & Compliance team and across the organization globally.
  • Dotted-line report to Head of Legal, China, to support local legal matters when workload allows.
  • Works closely with members of the local China legal team.
QUALIFICATIONS/ KNOWLEDGE/ EXPERIENCE
  • Qualified PRC lawyer
  • At least 6 years’ experience advising on at least one of JM’s key compliance risk areas (one of which must be anti-bribery and corruption) gained in-house or at leading law firm
  • Experience providing high quality, commercially focused and pragmatic legal advice
  • Experience considering and working to resolve ethical issues in a business context
  • Experience working in an international environment
  • Familiarity with Chinese bidding and tendering law
  • Familiarity with Chinese public procurement process
  • Experience advising business in relation to construction projects and, in particular, with obtaining relevant licenses and permits
  • Good understanding of the JM Group businesses and the Ethics & Compliance environment within which they operate
  • Fluent in Mandarin and English
  • Understanding of – and ability to relate to – diverse cultures
  • Team player with ability to build strong relationships and trust across wide range of audiences
  • Influential with senior leadership
  • Confidence to be resolute in the application of JM’s standards and to challenge commercial and business teams on this where necessary
  • Confidence and capability to carry out day-to-day workload without supervision
